BACKGROUND: This is an important week for the prospects of the Certified Seasonal Employer Designation language. The House DHS Appropriations Subcommittee is expected to mark-up the FY27 DHS Appropriations baseline bill on Friday, June 5. It is next to impossible to strip the language later in the process when it is included in the baseline bill and not as an amendment. This language is supported by President Trump and the White House. In fact, President Trump requested the inclusion of this language in the January minibus. It was stripped out at the last minute due to demands from Senate Judiciary Democrats.

ABOUT CERTIFIED SEASONAL EMPLOYER DESIGNATION: The Certified Seasonal Employer Designation allows employers who have demonstrated a history of compliance in the program (received labor certification the last five years) to have the highest number of workers they were certified for in those five years permanently exempted from the cap. This language rewards long-time, compliant users of the H-2B program.
